These Terms of Service (“Terms”) govern your use of the Cymata mobile application (the “App”) provided by Cymata (“we”, “us”, or “our”). By using the App, you agree to these Terms.
1. Agreement to terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved by Cymata.
4. User conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or modify the App
- Interfere with the operation or security of the App
- Use the App in a way that could harm other users or the service
5. Disclaimers
The App is provided for entertainment, creative, and general wellness purposes only. The App does not provide medical advice and is not intended to diagnose, treat, cure, or prevent any medical condition. Always seek advice from a qualified healthcare provider if you have concerns about your health.
Visual and Sensory Warning: The App may display dynamic, high-contrast, flashing, or rapidly changing visual patterns. These visual effects may not be suitable for individuals with photosensitive epilepsy or other sensitivities to light or visual stimuli.
If you have a history of seizures, epilepsy, or visual sensitivity, you should consult a qualified medical professional before using the App. If you experience discomfort, dizziness, disorientation, or any adverse symptoms while using the App, discontinue use immediately.
Your use of the App is at your own risk.
6. Limitation of liability
To the maximum extent permitted by law, Cymata shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury arising from your use of or inability to use the App.
7. Subscriptions and payments
The App may offer in-app purchases or subscriptions. Payments are processed through Apple App Store and are subject to Apple’s terms and conditions.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings.
All purchases are final and non-refundable except as required by applicable law or Apple’s policies.
8. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms or misuse the App. You may stop using the App at any time.
9. Changes
We may update these Terms from time to time. Continued use of the App after changes are made constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.
